Introduction

Welcome to EINSTAR forum, a community platform designed for customers to share thoughts and experiences. These Terms of Service (“Terms”) govern your use of the forum and its services. Please read this Terms carefully before accessing or using the Forum. By accessing or using any part of the Forum, you agree to become bound by the Terms provided by Shining 3D Tech Co., Ltd(“Shining 3D”). The Forum is available only to individuals who are at least 18 years old.

Account Registration

To participate in discussions, you must register for an account. You are responsible for maintaining the confidentiality of your account and password, and for restricting access to your account.

You must immediately notify Shining 3D of any unauthorized uses of your account or any other breaches of security. Shining 3D will not be liable for any acts or omissions by You, including any damages of any kind incurred as a result of such acts or omissions.

User Conduct

You agree to use the forum in a manner consistent with any and all applicable laws and regulations. You may not use the forum for any illegal or unauthorized purpose.

You are not allowed to express hatred for people based on characteristics like: race, ethnicity, nationality, gender, gender identity, sexual orientation, religion, age, disability.

You are not allowed to post any abusive, obscene, vulgar, slanderous, hateful, harassment, threatening, libel, defamation, inflammatory or otherwise inappropriate content, false statement or which otherwise violates the rights of Shining 3D or any third party (including any intellectual property rights, privacy rights, contractual or fiduciary rights), or otherwise shows any person, entity or brand in a bad or disparaging light, without their prior explicit approval.

You are not allowed to automate access to the forum, or monitor the forum, such as with a web crawler, browser plug-in or add-on, or other computer program that is not a web browser.

You are not allowed to hyperlink to images or other non-hypertext content on the forum on other web-pages. Don’t post links to phishing or other malware sites. URLs with referrer tags or affiliate codes are not allowed.

You are not allowed to post any content getting advertised via unwanted electronic messages such as spam links on newsgroups, email lists, other blogs and web sites, and similar unsolicited promotional methods; you are not allowed to use the Forum to gather addresses or other personal data for commercial mailing lists or databases. Contents about your own or other competitors products or services are prohibited.

Intellectual Property

Nothing in these terms gives you any ownership rights in Shining 3D’s intellectual property. You may not remove any marks showing proprietary ownership from materials you download from the Forum.

You retain ownership and sole responsibility of any content you post on the Forum. You must not post content that infringes the intellectual property rights of others. You shall only post your own content or content that you have permission to use on Forum.

By posting content, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, display, and distribute your content in connection with the Forum.

Privacy

Shining 3D respects your privacy and will only collect and use your personal information as outlined in our Privacy Policy.

Consequences for violations

Violations of Terms make the Forum less trustworthy, safe, and useful. If you violates the Terms, Shining 3D reserve the right to limit your ability to use Forum features, suspend or terminate your account. Also, Shining 3D reserve the right to change, redact and remove any content for any reason.

If someone violates applicable laws and Terms, Shining 3D might take legal action.

If you believe someone has submitted content to the forum in violation of the law or these terms, please e-mail us immediately.

Disclaimer of Warranties

THE FORUM IS PROVIDED “AS IS” WITHOUT ANY WARRANTIES OF ANY KIND. SHINING 3D DOES NOT WARRANT THAT THE FORUM WILL BE UNINTERRUPTED OR ERROR-FREE.

Indemnification

You agree to indemnify and hold harmless Shining 3D, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Forum, including but not limited to your violation of the Terms.

Limitation of Liability

Shining 3D has not vetted the content on the Forum, including software, and is not responsible for its effects or accuracy. The Forum might also include offensive material, inaccuracies, and errors. It may also contain content that breaches privacy, publicity rights, or intellectual property rights, with additional terms applying to its use. Shining 3D is not accountable for harm from using the Forum or downloading its content.

Shining 3D does not control or endorse linked websites and is not responsible for their content. You must take precautions against harmful content from these sites. Shining 3D is not liable for harm from using linked non-Shining 3D websites.

In no event shall Shining 3D be liable for any indirect, incidental, special, consequential or punitive damages arising from the use of the Forum.

Changes to the Terms

Shining 3D reserve the right to, at its sole discretion, to modify or replace any part of the Terms at any time. Your continued use of the forum following any changes indicates your acceptance of the modified Terms.

Termination

Shining 3D may terminate your access to all or any part of the Forum at any time, with or without cause, with or without notice, effective immediately. All provisions of the Terms which by their nature should survive termination shall survive termination, including but without limitation, Intellectual Property, Disclaimer of Warranties, indemnity and limitations of liability. Either you or Shining 3D may end the Terms at any time, your access and use to the Forum will not be available in the meantime.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of People’s Republic of China, without regard to its conflict of law provisions.

Any dispute arising from or in connection with this Terms shall be submitted to China International Economic and Trade Arbitration Commission (“CIETAC”) Zhejiang Sub-Commission for arbitration which shall be conducted in accordance with the CIETAC’s arbitration rules in effect at the time of applying for arbitration. The arbitral award is final and binding upon both parties.

Assignment

You may not assign your rights and obligations under the Terms. Shining 3D may assign its rights and obligations under the Terms to any its affiliates, any other company that obtains control of Shining 3D, or any other company that buys assets of Shining 3D related to the Forum. Any attempted assignment against the Terms has no legal effect.
